1. Introduction

These Terms and Conditions ("Agreement") govern the services provided by Adaptation Engineering ("Engineer", "we", "us", "our") to customers ("you", "your") regarding vehicle modification certification in Victoria, Australia. By engaging our services, you agree to these terms.

2. Scope of Services

We provide engineering assessments and certification for modified vehicles in accordance with relevant Victorian and Australian regulations. Our role is to assess compliance with legal and safety standards, not to approve modifications based on preference or convenience.

3. Customer Responsibility

It is your responsibility to understand why you require an engineering certification before engaging our services. We provide professional advice but do not obtain approvals from VicRoads or other authorities on your behalf.

You must provide accurate information about your vehicle and modifications. Any incorrect or incomplete information may result in additional costs or a failed certification.

If you are unsure whether your modifications require certification, you should check with VicRoads or the relevant regulatory body before booking.

4. Quotations and Pricing

Any quotation provided by Adaptation Engineering is valid for 30 days unless stated otherwise. Prices may change if additional work or re-inspections are required.

We reserve the right to amend pricing before acceptance of an order or due to unforeseen costs.

5. Pre-Inspection Deposit and Fees

A non-refundable deposit is required at the time of booking a pre-inspection. This covers our time assessing the vehicle, reviewing documentation, and providing initial advice.

If you proceed with full certification, the deposit may be credited toward the total certification fee.

The full cost of certification will be quoted after the pre-inspection. Additional work (such as testing or further documentation) may incur extra charges.

Failure to attend a scheduled pre-inspection without 24 hours’ notice will result in forfeiture of the deposit.

6. Payment Terms

The balance of all invoices is due within 14 days of issue.

If an invoice is for a deposit, full payment must be made before the agreed inspection date.

A 2% discount will be applied if full payment for a standard invoice (excluding deposits) is received within 7 days of the invoice date.

Late payments may incur interest at 2% per month, calculated daily.

We reserve the right to suspend or withhold certification documents until full payment is received.

7. Order Cancellations

Once an order is placed and accepted, cancellations are not permitted, and any deposit or fees paid will not be refunded.

Adaptation Engineering reserves the right to cancel an order before completion if:

- The vehicle is found to be non-compliant beyond rectification.

- Required information is not provided in a timely manner.

- External circumstances prevent the completion of certification.

8. Certification Outcome

Paying for an inspection or certification does not guarantee approval of your vehicle.

If your vehicle is found to be non-compliant, you will be given recommendations for rectification, but additional inspections may be required at extra cost.

We do not modify vehicles ourselves; we only assess modifications for compliance.

9. Liability and Indemnity

We are not responsible for any costs incurred due to non-compliance, failed inspections, or required rectifications.

You agree to indemnify Adaptation Engineering against any claims, damages, or costs arising from:

Incorrect or incomplete information provided by you.

Any legal action taken due to non-compliant modifications.

Any third-party damage or liability resulting from your modifications.

We are not liable for any loss of time, inconvenience, or business revenue due to certification delays or outcomes.

10. Force Majeure

We will not be liable for any failure to perform, or delays in performing, our obligations due to events beyond our control, including but not limited to regulatory changes, supply chain disruptions, natural disasters, or government-imposed restrictions.

11. Intellectual Property & Confidentiality

Any documents, reports, or assessments provided by Adaptation Engineering remain our intellectual property.

You may not reproduce, distribute, or modify our documentation without prior written consent.

Any confidential information provided by either party must remain confidential unless required by law.

12. Changes and Amendments

We reserve the right to amend our fees, terms, and conditions at any time.

If we are unable to complete a booked service due to unforeseen circumstances, we will offer a rescheduled appointment or refund at our discretion.

13. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in Victorian courts.
